Right to Access

You have the right to inspect and obtain a copy of your PHI maintained in our designated record set. Requests should be submitted in writing to our Privacy Contact. We may charge a reasonable cost-based fee for copies.

Right to Amendment

You have the right to request that we amend PHI that you believe is inaccurate or incomplete. We may deny your request under certain circumstances, and we will provide a written explanation if we do.

Right to an Accounting of Disclosures

You have the right to request a list of certain disclosures of your PHI made during the six years prior to your request. This right does not apply to disclosures made for treatment, payment, or healthcare operations.

Right to Request Restrictions

You have the right to request restrictions on how we use or disclose your PHI. We are not required to agree to all requested restrictions. However, if you pay for a service out of pocket in full, we must honor your request to restrict disclosure of that service to your health plan.

Right to Confidential Communications

You have the right to request that we communicate with you about your PHI in a specific way or at a specific location. We will accommodate reasonable requests.

5. Mental Health Record Protections

California law provides additional protections for mental health records. Certain psychotherapy notes and mental health treatment records may require a separate, specific authorization before disclosure, beyond what is required under HIPAA. Ryse Wellness complies with applicable California mental health privacy statutes, including the Lanterman-Petris-Short Act (LPS Act) and related provisions.

6. Breach Notification

In the event of a breach of your unsecured PHI, Ryse Wellness will notify you as required under the HIPAA Breach Notification Rule (45 CFR Part 164, Subpart D). Notification will be provided without unreasonable delay and in no case later than 60 days following discovery of the breach.
